ONLINE STORE TERMS & CONDITIONS;
SECTION 1 - ORDERS CANNOT BE AMENDED AFTER THEY ARE PLACED
We cannot amend any aspect of your order once it is placed. This includes your delivery address, email address, items contained within the order (including sizes), payment method, application of Discount Codes or any other aspect of the order.
If you have ordered an item that you no longer want you can use our Returns Proceedures, found here, to return your Order.
SECTION 2 - ORDERS CANNOT BE SHIPPED TO ANYONE OTHER THAN THE CARDHOLDER (USING CREDIT OR DEBIT CARD).
In order to limit fraudulent Credit / Debit Card transactions, we are unable to ship orders to anyone other than the Cardholder, at the Cardholder's Registered Billing Address, (with the exception of Delivery to Store orders), when you choose this payment method.

Should you wish to ship to an alternative person or address, we can only accept payment via the following methods as they use enhanced security;

SECTION 3 - SIZE CHARTS AND OTHER DESCRIPTIVE INFORMATION
All information contained within our Size Charts is provided by the manufacturer. Whilst we believe this information to be reliable, we cannot take responsibility for errors made in such information and so cannot accept any cost incurred due to sizing irregularities (example return shipping).

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability.
Occasionally system errors can also occur, for example pricing at £0.00 / Euro 0.00. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information, including pricing, is inaccurate, at any time without prior notice (including after you have submitted your order). Please note that by proceeding through the checkout you have accepted these Terms & Conditions.* **
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
*If your order has contained any items that have a pricing error, your entire order will be cancelled.
**Your payment will be refunded automatically but delays in the funds reaching you can occur due to your Bank's processing times - typically 2-4 Working Days.
SECTION 5 - PRICE MATCH REQUESTS
We do offer the option for visitors to our site to request that we match a competitor's price.
We do not offer a Price Match 'Guarantee' whereby we guarantee to match a competitor's price, nor do we advertise our Price Match as such.
A price Match Request can be either approved or refused based on a number of criteria including the type of competitor, our cost price and current stock levels, current offers and discounts and whether or not we are stocking the item in future seasons as opposed to an item being discontinued.
Although Price Match requests are very often approved on occasion we will decline them for the above reasons. We are not always able to provide a specific reason for a Price Match Request being declined as we are unable to provide sensitive company information such as cost price and stock levels.
We do not Price Match against Amazon, eBay or any similar platforms as we cannot verify that the sellers are authorised distributors of the items and in turn we cannot confirm that the items are authentic.
Often, particularly during our Sale Periods, our DV8 stores will have offers and discounts that do not match our online prices. We do not guarantee to price match against DV8 stores and will consider each request on a case-by-case basis.
You should provide a link to the specific product on the competitors website when requesting a Price Match. You can do this by copying the link at in the search bar at the top of the page and pasting it into the Price Match request. We cannot authorise any Price Match Requests where the link provided is not to the specific product that is being matched.
DV8 reserves the right to alter or withdraw this offer without notice.
SECTION 6 - NEWSLETTER SIGNUP DISCOUNT CODES
This discount cannot be used in conjunction with any other offer, discount, reduction or sale item.
We will email you a Discount Code shortly after you sign up. Please be aware that depending on your email provider's settings, it is possible that this code will be filtered into your Junk / Spam folders, so if it does not appear in your inbox please check these folders.
Discount Codes are for "New Customers" and must be used within 30 days of sign up. Once the 30 days have passed the customer is no longer considered a "New customer" and the discount code will expire.
Once a Discount Code has expired it cannot be reactivated, nor can a second Discount Code be issued to that email address.
If you complete your order without applying the discount code the discount cannot be appled retrospectivley and so we are unable to accept requests to discount once an order has been placed.
DV8 reserves the right to alter or withdraw this offer without notice.
SECTION 7 - 3 FOR 2 OFFER;
In our 3 for 2 offer it is the cheapest item that is free. The offer is only available online.
If qualifying items are returned, only the discounted price will be refunded - the full discount received will be deducted from the first item returned.
The offer is not available in conjunction with any other offer e.g. Newsletter Sign Up discount. All items are subject to availability. Offer is only valid on advertised dates. DV8 reserves the right to alter or withdraw this offer without notice.
SECTION 8 - STUDENT DISCOUNT IN THE ONLINE STORE;
We have partnered with Student Beans to offer Student Discount.

8.1 This discount cannot be used in conjunction with any other discount, offer or reduction.
We reserve the right to dicontinue this discount at any time without prior notice.
E-GIFT VOUCHERS, GIFT CARDS & CREDIT NOTES;
SECTION 9: ONLINE E-GIFT VOUCHERS
Online E-Gift Vouchers are only redeemable in our online store, they are not redeemable in our Retail Stores.
Online E-Gift Vouchers are delivered via email to the person who has purchased the voucher. It can then be forwarded to the recipient at a time of the purchaseors choosing.
Online E-Gift Vouchers are Valid for 12 Months from purchase.
Once purchased, Online E-Gift Vouchers cannot be refund.
Once purchased, Online E-Gift Vouchers cannot be exchanged to any other form of voucher, gift card or credit note.
To redeem an Online E-Gift Voucher please enter the Voucher Code into the Checkout. Please note that this must be done before checkout and cannot be done retrospectively.
SECTION 10: IN-STORE GIFT CARDS
In-Store Gift Cards are only redeemable in our retail stores, they are not redeemable in our Online Store.
In-Store Gift Cards are delivered via post to the delivery address submitted in the checkout.
In-Store Gift Cards are Valid for 24 Months from purchase.
Once purchased, In-Store Gift Cards cannot be refund.
Once purchased, In-Store Gift Cards s cannot be exchanged to any other form of voucher, gift card or credit note.
Once an In-Store Gift Card has been issued it is the responsibility of the customer to retain the voucher. DV8 Fashion cannot be held liable for lost or stolen Gift Cards / Credit Notes and are unable to replace them.
SECTION 11: IN-STORE CREDIT NOTES
In-Store Credit Notes are only redeemable in our retail stores, they are not redeemable in our Online Store.
In-Store Credit Notes are Valid for 6 Months from issue.
Once issued, In-Store Credit Notes cannot be exchanged for any other type of credit, eg cash.
Once an In-Store Credit Note has been issued it is the responsibility of the customer to retain the voucher. DV8 Fashion cannot be held liable for lost or stolen Credit Notes and are unable to replace them.
SECTION 12 - IN-STORE LOYALTY CARD.
1. The DV8 Loyalty Card Sheme only operates in our Retail Stores, you cannot accumulate or spend Loyalty Card Points on DV8 online.
2. Loyalty Card Holders must produce their Card when making a purchase to either accumulate or spend points.
3. Points cannot be added onto your Card at a later date - this must be done in the original transaction.
4. Loyalty Points can not be accumulated or spent when using our Layaway facilties.
5. If you lose your Loyalty Card please go to your local DV8 store where our Store Team will issue you with a New Card and then have this new Card Linked to your Loyalty Account.
6. Only the Card Holders purchases can be used to accumulate points or spend points.
DV8 reserves the right to alter or withdraw this offer without notice.
SECTION 13 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We accept Visa, Visa Debit, Maestro, MasterCard and PayPal.
The prices shown on our website include any VAT (or similar sales tax) at the prevailing rate for which we are responsible as the seller. The amount you pay will be the price indicated plus any delivery charges. Please note that the recipient of any products shipped outside the European Union may also have to pay import duty or other taxes, fees and charges applied by customs or other authorities in the country of receipt. If you are unsure about whether these charges might apply to your order, you should contact your local tax or customs authorities.
The actual price charged to overseas customers will be subject to the exchange rate applied by the customer's credit or debit card company. Customers outside the United Kingdom will also be liable for any import duty, quotas, permits, product restrictions and other local requirements. You are advised to check latest applicable local requirements before placing an order.

Credit / Debit Card Validation.
All credit/debit cardholders are subject to validation checks and authorisation by the card issuer, as well as verification from 3D Secure.
If the issuer of your payment card refuses to, or does not for any reason, authorise payment then you will be notified of this immediately at the check out stage.
3D SECURE Screening.
After Checkout your payment will pass through the 3D Secure Anti-Fraud Screening.
This feature looks for any irregularities with the details entered into the checkout such as; Addressee name not matching the Card Holder Name, multiple attempts to enter Card Number, attempts to use more than one Card, shipping to an address other than the Billing Address, or shipping to a different country than the one that the card was issued in. The feature also looks for other data and patterns that cannot be disclosed.
In some cases, depending on the severity, one irregularity may be enough to cause the system to identify the transaction as potentially fraudulent, in some cases it may take multiple issues to cause this.
Once a payment has been flagged by 3D Secure as containing irregularities, it is our policy to cancel the transaction and refund the money to the Card Holder, by proceeding through the checkout you are confirming that you have understood this and all of our Terms & Conditions.
Please note that as soon as a cancellation occurs the money is immediately returned to the Card Issuer, however as with all standard refunds it may take 3-5 Working Days to appear in the Card Holder's account, this is the Card Issuer's processing time and is beyond our control.
Please Note: In line with Best Practice Guidelines, we may be unable to advise as to the specific reason that a transaction failed 3D Secure. This is to ensure that we do not provide information that would assist someone who is attempting to carry out a fraudulent transaction.
You will receive an email with "Order Cancelled" in the subject line. In line with Best Practice guidelines this will not contain any detailed information to explain the reason. This is intentional and is to prevent us from assisting someone who is attempting to carry out a fraudulent transaction.
ADDITIONAL PAYMENT AND SECURITY INFORMATION CONT.
We may also use your information for the purposes of the prevention and detection of fraud. One of the purposes for which we may disclose your address and postcode details is to check against the IMRG Security Alert or any other Credit Reference Agency or Fraud Prevention Scheme.
At all times where we disclose your information it will remain secure.
If you believe your details are incorrect you may correct those details by following the procedure set out in our Privacy Policy.

Verified by Visa and MasterCard SecureCode follow the same principles as Chip and Pin, by helping to protect your card against unauthorised use when you shop via the Internet.

This is a one-off registration process, so you will be able to use the same password for all future purchases you make with participating retailers.

RETURNS POLICY FOR IN-STORE PURCHASES;
For items purchased through our retail stores we are happy to offer a refund, exchange or Credit Note for any merchandise returned within 28 days of purchase, providing goods are in their original condition, unworn, with all labels & packaging and accompanied by proof of purchase.
Exchanges can be made within 28 days of the original purchase under the above conditions. Occasionally we will extend the exchange period, for example at Christmas time and this will be stated at the bottom of the receipt if applicable to your purchase.
We regret that for hygiene reasons swimwear, underwear and earrings are non-returnable.
Proof of purchase is required with every refund or exchange, including Credit Card receipt where you have paid by this method.
To prevent Credit card fraud and general refund fraud you will be required to provide your name, address and telephone number as part of the refund transaction. In accordance with our Privacy Policy and GDPR, your information will not be used for marketing purposes or given to any organisation outside DV8 Fashion, other than statutory government bodies where we are required by law to provide it.
A Gift Receipt entitles the bearer to an exchange to the same value of the goods returned. Returns with Gift Receipts are subject to the same Terms and Conditions stated above (28 Days for and exchange unless otherwise stated on the receipt). We do not offer a refund on items returned with a Gift Receipt.
